Terms of Service

1. Introduction
Welcome to ASiS ("Platform", "we", "us"). ASiS is a peer-to-peer marketplace for buying and selling second-hand fashion and homeware in the United Kingdom, built around escrow protection for both buyers and sellers.
ASiS is operated by AsiswebsiteLTD, a company registered in England and Wales under company number 17141700.
By creating an account and using our services, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.
These Terms should be read with our Privacy Policy, Cookie Policy and Listing Rules.
1.1 Beta
ASiS is currently in closed beta. Access is controlled by an access code, some features are unfinished, and card payments may run in Stripe test mode, in which case no real money moves. Data may be reset during the beta period. We will tell you in-app when the Platform moves out of beta and payments become live. Some features shown in the Platform may be disabled or marked as coming soon. In particular, business selling and live selling/auctions are not available at launch.
2. Eligibility
You must be at least 18 years old and resident in the United Kingdom to use ASiS. By signing up, you confirm that you meet these requirements and that you are able to enter into a binding contract.
ASiS currently permits private individual sellers only. You may sell your own personal used or unwanted items.
Business selling is not currently available on ASiS. We may introduce business sellers in future and will publish additional terms and requirements before doing so.
3. Account responsibilities
You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration and keep it up to date. You may not create multiple accounts or impersonate others. You are liable for all activity conducted under your account.
Multiple accounts and ban evasion
Users may not create, control, operate or benefit from multiple ASiS accounts without our prior written permission.
Attempting to evade restrictions, suspensions, bans, verification requirements, account limits or Platform safeguards through the use of additional accounts may result in the suspension or permanent removal of all associated accounts.
Closing your account
You may close your account at any time from Profile → Account settings → Delete my account. Because we are required to keep transaction records for tax and accounting purposes, closing an account anonymises it rather than erasing everything; the detail of what is deleted, anonymised and retained is set out in our Privacy Policy.
We will not close an account while an order is still in progress, a dispute is open on either side, an active listing has an offer awaiting an answer, a payout or refund is still being processed, or funds are still sitting in your payout account.
4. Identity verification and information requests
To protect users and comply with legal, fraud-prevention and trust-and-safety obligations, ASiS may request additional information from you at any time, including:
- Proof of identity
- Proof of ownership
- Proof of purchase
- Address verification
- Other supporting documentation reasonably required for investigations, disputes, compliance checks or account reviews
The Verified badge
Sellers may apply for verification from Profile → Verify. Identity checks are carried out through Stripe Identity, and verification is available to people aged 18 or over. Verification is optional for ordinary selling and is one of the requirements for the highest seller tier (see section 13).
Failure to co-operate with a reasonable verification request may result in listing removal, account restrictions, suspension, withholding of funds, or permanent account closure.
5. Buying and selling
Permitted categories
Sellers may list items falling within the categories available on the Platform at the time of listing. These currently are:
- Tops
- Dresses
- Denim
- Outerwear
- Shoes
- Bags
- Accessories
- Home & Furniture (collection only — see section 9)
Items outside these categories, or that do not meet the conditions stated in these Terms, are prohibited. Sellers must accurately describe items, including brand, size, condition and defects, and list them in the appropriate category.
The condition report
Every listing must include a completed condition report. You will be asked a set of category-specific questions (for example, crotch wear on denim, corner wear on bags, sole wear on shoes) and must answer each as None, Minor or Noticeable.
Any answer other than "None" must have at least one close-up photograph attached to that specific answer. A listing cannot be published while a declared flaw is missing its photo.
The condition report is the core of how ASiS works. Deliberately understating a flaw, or omitting one you knew about, is a breach of these Terms, will count against you in a dispute, and will lower your accuracy score (section 13).
Listing photographs
All listing photographs must be original photographs of the actual item being offered for sale, taken by the seller. This applies to all sellers permitted to use the Platform.
The following are not permitted:
- AI-generated or fully AI-created product images
- Images copied from websites, search engines, social media, catalogues or other sellers
- Manufacturer, retailer or supplier stock photos
- Screenshots of product images from another source
- Images of a different item, even if it is the same brand, model, colour or product type
- AI editing that changes the item's condition, colour, shape, branding, packaging, features or appearance
- Background replacement or enhancement that could mislead a buyer about the item
Basic editing such as cropping, rotation, brightness correction and removal of personal information is permitted only where it does not alter or misrepresent the product.
Counterfeits
Sellers must not list counterfeit, replica or fake items. All branded items must be genuine. Listing counterfeit goods is a criminal offence under the Trade Marks Act 1994. Suspected counterfeit listings are hidden or removed pending human review, and confirmed cases result in enforcement proportionate to severity, up to permanent closure of the account and removal of all listings. Every decision can be appealed once within 14 days (section 17).
Prices and buying
- Prices are listed in GBP and represent the seller's asking price. The buyer protection fee and any shipping cost are added at checkout and paid by the buyer.
- A listing may have more than one unit available. Buyers may purchase up to 50 units of a single listing in one order. The buyer protection fee is charged once on the order subtotal, not per unit.
- Tapping Buy now takes you to checkout, where you must complete payment to secure the item. No charge is taken automatically — you must complete the Stripe checkout yourself. Incomplete checkouts expire and release the item back to the marketplace.
Holds
A buyer may place a 30-minute hold on a listing while they decide or arrange payment. While a hold is active, no other buyer can check that listing out. A buyer may hold up to 3 items at once, and may release a hold early at any time. Holds are not reservations of ownership and expire automatically.
Offers
Where a seller has enabled offers on a listing:
- An offer must be below the asking price and at least 50% of the asking price.
- Either side may accept, decline or counter. There is a maximum of 3 rounds per buyer per listing.
- Only the recipient of the latest offer may respond to it.
- An accepted offer reserves the item for the buyer for 24 hours, after which the accepted price expires and the item returns to sale at the asking price.
Dispatch
The dispatch window is 3 calendar days after payment. A seller may request one 12-hour extension per order before the deadline expires. If the item is not dispatched by the deadline, the order is cancelled automatically and the buyer is refunded in full without further notice.
Repeated failure to dispatch, repeated cancellations, or cancelling to avoid an agreed price may result in listing removal, feature restrictions or account suspension.
6. Payments, fees and escrow
Selling is free
ASiS charges sellers nothing. There are no listing fees, no monthly fees and no commission on the sale price. Sellers receive 100% of their asking price (or of the accepted offer amount).
What buyers pay

The buyer protection fee is identical on every purchase. Seller membership and seller trust tiers never change the buyer's price or the buyer's level of protection.
Home & Furniture listings are collection-only. The normal buyer protection fee applies to collection orders unless the checkout explicitly states otherwise. Escrow, dispute and refund protections apply to collection orders in the same way as other paid orders.
Escrow
Every payment on ASiS is held in escrow. The seller cannot access the money at the point of sale.
Funds are released to the seller when:
- the buyer confirms receipt of the item; or
- 5 days have passed since delivery with no dispute raised.
A buyer must raise a dispute before the release occurs. Once a dispute is opened, the release clock stops and funds remain held until the dispute is resolved. ASiS may take reasonable steps to recover or reverse a payout if a dispute is validly opened before the applicable deadline but the funds have already been released.
Payouts
- Payouts are processed through Stripe Connect to the seller's connected payout account.
- Standard payment-processing fees are absorbed by ASiS and are not deducted from the seller.
- Standard payout speed after release depends on the seller's trust tier: 7 days at As Listed, 3 days at As Promised, 1 day at As Always.
- Instant payout is optional and opt-in. It costs 1.5% of the amount, reduced to 1.25% at As Promised and 1% at As Always. It is available separately from membership and is never bundled with it.
Direct payment is prohibited
You must never pay a seller, or ask a buyer to pay you, outside ASiS checkout. Bank transfers, cash, gift cards and payment links are not protected by escrow and are a breach of these Terms. If a user asks you to pay off-platform, report them.
7. Live selling and live auctions
Live selling and live auctions are not currently available on ASiS. If these features are introduced, additional terms will apply before they become available.
Any references elsewhere in the Platform to live selling, auctions, bidding or live-session features do not make those features available unless ASiS has expressly enabled them for your account.
8. Free items
Sellers may list items as free — things they want gone rather than sold.
- Free listings never touch payments, escrow, protection fees or orders. Nothing is charged, so there is nothing to hold and nothing to refund.
- Free items still require the full condition report and flaw photographs, plus an optional "not working / for parts or repair" declaration.
- Free items are collection only. Collection is arranged between the two of you in chat.
- Interested users send a request. The seller chooses who gets it. The chosen person has 24 hours to confirm, after which the seller may pick someone else.
- A user may have a maximum of 3 open requests at any time.
- There are no disputes on free items, because no money was paid. You can still report a no-show, or anything prohibited or unsafe.
Everything in section 15 (Prohibited items) and section 16 (Prohibited conduct) applies to free listings exactly as it does to paid ones.
9. Delivery, collection and shipping

Shipping prices are quoted at checkout and are priced server-side; the price shown to the buyer at checkout is the price that applies.
Meeting in person to hand over a paid item ("meet-up") is not currently available in the United Kingdom and will be enabled as ASiS launches in more locations.
Seller responsibilities
- Sellers must use the delivery option the buyer paid for and must add a tracking number where the service requires it. An order cannot be marked as shipped without one.
- Sellers are responsible for packaging items securely and appropriately for transit. Damage caused by inadequate packaging is the seller's responsibility.
- Sellers must ensure the parcel is within the size and weight limits of the service purchased. Additional carrier charges arising from an oversized or overweight parcel may be recovered from the seller.
- Using a different carrier or service from the one paid for voids tracking and may void buyer protection on that order.
Carrier terms
By selecting a shipping option through ASiS, the seller confirms that the parcel complies with the selected carrier's restrictions, that the item is not prohibited by that carrier, and that they understand certain goods are classed as non-compensation items under carrier terms. ASiS is a marketplace and is not liable for delays or losses caused by third-party carriers; carrier compensation limits apply.
Any delivery charge shown to the buyer at checkout is the charge payable for that order.
If a buyer does not collect a parcel and the parcel is returned to the seller, the buyer will receive a refund of the item price only. The buyer protection fee and original shipping charge are non-refundable, except where a refund is required by law or ASiS agrees otherwise because of its own error. The seller will not receive a payout for the cancelled order.
Dispatch and unboxing evidence
ASiS uses two-sided photographic evidence to make disputes decidable.
Dispatch evidence. Before marking an order shipped, the seller photographs the packed item and may record the parcel's weight and dimensions.
Unboxing evidence. On arrival, the buyer photographs opening the sealed parcel — at least three photographs showing the sealed parcel with its label, the parcel mid-opening, and the item revealed. Unboxing photographs must be taken with the camera at the time; uploading images from your library is not accepted.
Submitting unboxing evidence releases the buyer's locker unlock code, where the delivery method requires one.
Both sets of evidence are checked for consistency and are the primary material used to decide a dispute. Unboxing notes are kept privately unless a dispute is opened.
Refusing or failing to provide evidence when asked will be taken into account when a dispute is decided.
10. Returns, cancellations and refunds
This section sets out when an item can be sent back and who pays.
10.1 Cancelling before dispatch
A buyer may cancel an order at any point before the seller marks it as dispatched. The item price and shipping fee are refunded to the buyer's original payment method. The buyer protection fee is non-refundable, except where a refund is required by law or ASiS agrees otherwise because of an error by ASiS.
An order that is not dispatched within the dispatch window is cancelled and refunded in full automatically (section 5).
10.2 Purchases from private individual sellers
No change-of-mind returns. Private individual sellers are not required to accept a return because an item does not fit, the colour is different in person, or the buyer has changed their mind. In those circumstances the sale is final.
Consumer law does not apply between private individuals. The Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 apply to purchases from traders. They do not apply to a sale between two private individuals. The seller must still describe the item accurately, must legally own it, and must have the right to sell it.
Buyer protection still applies. A buyer may open a dispute where an item is significantly not as described, damaged in transit, counterfeit, the wrong item, or was never received. That process is set out in section 11.
10.3 Business sellers
Business selling is not currently available on ASiS. No seller may use ASiS to trade as a business or trader while this launch restriction is in place. If business selling is introduced, ASiS will publish the additional terms and statutory-rights information that apply before the feature is enabled.
10.4 Who pays return postage
Where ASiS determines that a return is required because an item is significantly not as described, counterfeit, the wrong item, or damaged in transit due to the seller's responsibility, the seller is responsible for reasonable return postage. ASiS will provide instructions for the return and may arrange the return process through the available delivery service.
A buyer must not return an item before ASiS has agreed that a return is required and provided return instructions.
10.5 How refunds are issued
- Refunds are issued to the buyer's original payment method through Stripe.
- Where the seller has already been paid out, ASiS reverses the payout before refunding, so the seller's account may go into a negative balance which is recovered from future sales.
- A refund may be full or partial, depending on the outcome of the dispute.
- Refunds are processed as soon as the outcome is decided. Card refunds typically take a few working days to appear on your statement, depending on your bank.
The buyer protection fee is non-refundable, including where a dispute is decided in the buyer's favour and the item price and shipping are refunded in full. The fee pays for escrow, human dispute review and card processing, which are provided whatever the outcome. The only exceptions are where a refund of the fee is required by law, or where ASiS agrees to refund it because of an error by ASiS.
10.6 Items sent back without agreement
Do not send an item back before a return has been agreed or ordered. An item returned without agreement may not be refunded, and ASiS cannot recover an item that has been posted to an address obtained outside the Platform.
10.7 Free items
There are no returns and no refunds on free items, because no money changed hands. See section 8.
11. Disputes and buyer protection
When you can open a dispute
A buyer may open a dispute within 5 days of delivery — or, for an item that never arrives, once the expected delivery window has passed. Message the seller first; most problems resolve there.
Grounds
A dispute must be opened on one of the following grounds:
- Item significantly not as described
- Item not received
- Damage in transit
- Item not authentic
- Wrong item sent
How a dispute is decided
- The buyer opens the dispute and attaches photographs and an explanation.
- The seller has 48 hours to respond with their own evidence — the listing, the condition report, dispatch photographs, tracking and chat history.
- A member of the ASiS team reviews both sides. We aim to decide within 72 hours of the dispute being ready to decide.
- We decide: full refund, partial refund, or release to the seller. The decision states the ground it was decided on and points to the specific evidence it turned on.
Funds do not move during a dispute. Escrow holds the payment until the dispute is resolved — the seller is not paid and the buyer is not refunded until we decide.
Appeals
Either party may appeal a dispute decision once, free of charge, within 14 days of being notified. Appeals are reviewed by someone who was not involved in the original decision, and we aim to respond within 7 days. Following an appeal decision, the outcome is final.
Failure to engage
If a party fails to co-operate, provide evidence, or respond within the time given, the dispute may be decided against them on the evidence available. Sellers who repeatedly misrepresent items or send counterfeits may have funds withheld, listings removed and their account suspended.
Lost in transit
If a tracked parcel has not arrived and ASiS reasonably determines that it has been lost, ASiS will treat it as lost after 14 days. Where neither buyer nor seller is at fault, ASiS bears the loss and will refund the buyer's item price and applicable shipping charge, subject to any rights ASiS may have against the carrier. The buyer protection fee remains non-refundable unless required by law or otherwise agreed by ASiS.
If the loss appears to result from the seller's failure to comply with packaging, carrier or dispatch requirements, ASiS may recover the relevant amount from the seller or take enforcement action.
12. Business sellers
Business selling is not currently available on ASiS. The Platform is launching for private individual sellers only. You must not use ASiS to sell as part of a business, trade or profession, including by buying goods for resale or regularly selling goods as a source of income.
ASiS may introduce business selling in future. If it does, it will publish additional terms covering trader status, statutory consumer rights, identity disclosure, cancellations, returns, refunds, tax and any other requirements before business selling is enabled.
13. Seller trust tiers and the accuracy score
Trust tiers
Every seller has a track-record tier, shown on their profile:

Tiers are calculated from confirmed sales, accuracy score, dispute rate and (for the top tier) identity verification. Tiers move down as well as up — the tier shown is always the highest tier the seller currently qualifies for.
Tiers never affect fees. Selling is free at every tier and the buyer protection fee is identical regardless of tier. Tiers affect payout speed, instant-payout rate, support priority and badges only.
Accuracy score
The accuracy score reflects how often a seller's items arrive as described. It is fed by confirmed sales with no issue raised, condition reports matching on arrival, condition mismatches flagged at review, disputes decided for or against the seller, and listings removed by moderation.
Sellers can see exactly which events moved their own score and by how much. The precise weightings are not published, because publishing them would turn the score into something to game rather than something to earn.
A tier or score is a record of past behaviour. It is not a guarantee by ASiS about any individual item, and it does not mean ASiS has inspected, authenticated or backed the sale.
14. Membership
Membership is optional and costs £4.99 per month or £49 per year.
Membership never changes fees. Selling is free for everyone and the buyer protection fee is the same on every purchase regardless of whether the seller is a member. Membership unlocks seller tools only:
- An editable storefront at asis.website/shop/your-name, with four on-brand themes
- Seller analytics — views, saves, offer conversion, accuracy trend
- £3 of promoted-listing credit each month, accruing only while the subscription is active and capped at three months' worth. A boost keeps a listing at the top of browse and search for 72 hours.
- Bulk tools — duplicate listings, save drafts, schedule go-live
- Member Lounge forum, and early access to new categories and cities
- 25 saved searches with price-drop alerts, against 3 on a standard account
- 30 minutes' first dibs on new listings from sellers you follow
- Member badge on listings and profile
- Priority support
- Additional seller tools that ASiS may make available to members from time to time, subject to the feature being launched and any additional terms that apply
Cancellation, renewal and refunds
- Monthly and annual memberships do not automatically renew.
- You may cancel at any time. Cancellation takes effect at the end of the paid membership period.
- If you cancel before the end of a paid period, you continue to receive the membership benefits until that period ends.
- Membership fees are not refundable for unused time, except where a refund or cancellation right is required by applicable law. If the law gives you a statutory cancellation right, nothing in these Terms removes or limits that right.
- When membership ends, unused promoted-listing credit expires.
- When membership ends, your storefront remains available as a basic storefront rather than disappearing.
15. Prohibited items
Our Listing Rules set out in full what may and may not be listed on ASiS, and how items must be described. Where these Terms and the Listing Rules conflict, the Listing Rules take precedence.
You may not list, sell, buy, advertise or distribute:
Illegal or dangerous
- Counterfeit, replica or unauthorised copies of any brand
- Stolen goods, or items you do not have the legal right to sell
- Anything unlawful to sell in the UK
- Weapons of any kind, ammunition, or items designed as weapons — including firearms, imitation firearms, tasers, pepper spray and knuckledusters
- Bladed items of any kind, including kitchen knives, pocket knives, penknives, craft and utility knives, scissors, shears, razors, blades sold loose, and blades that form part of another item. There are no exceptions, and this applies however old the item is. Under the Offensive Weapons Act 2019 it is a criminal offence to deliver a bladed product, or to arrange its delivery, to a locker or to residential premises without verifying at handover that the recipient is over 18. Every ASiS delivery option collects or delivers without an age check, so there is no lawful way to send a blade through this Platform.
- Prescription medicines, controlled substances, drugs and drug paraphernalia
- Hazardous, flammable or restricted materials — aerosols, solvents, fireworks, corrosives
- Loose or spare lithium batteries. Items containing a battery must be sent in line with the carrier's dangerous-goods rules.
Safety
- Items subject to an active safety recall. You are responsible for checking recall status before you list.
- Used safety equipment — child car seats, bike helmets, life jackets, climbing harnesses, body armour, buoyancy aids — which can be structurally compromised by an impact you cannot see and which a buyer cannot inspect for.
Health and hygiene
- Used underwear, lingerie, intimate apparel and swimwear. Permitted only if brand new, unworn, with original tags, in factory-sealed packaging. This includes bikinis, swimsuits, tankinis and swim shorts — used swimwear is not permitted on ASiS in any condition.
- Cosmetics, skincare, perfume, haircare and beauty products that are opened, used or expired
- Food and drink of any kind
- Prescription eyewear and contact lenses — regulated medical devices in the UK
- Tobacco, vapes, e-cigarettes and alcohol
Living things and protected species
- Live animals and insects
- Real fur of any kind, including vintage fur, fur trim, fur collars, fur linings and fur accessories. This applies whatever the species and however old the item is. Faux fur is permitted and must be described clearly as faux.
- Exotic skins, including snakeskin, crocodile, alligator, lizard, stingray and ostrich, real or claimed
- Ivory, tortoiseshell, bone, coral, and feathers from protected species
- Any other animal part or product from a protected or endangered species
Not physical items
- Digital goods, downloads, software, accounts, logins, subscriptions and services. ASiS is for physical items only.
- Gift cards, vouchers, e-vouchers and event tickets
Rights and age restrictions
- Anything infringing intellectual property — trade marks, copyright, design rights or patents
- Anything infringing another person's privacy, including items containing someone else's personal information
- Adult or sexual content and items, and anything requiring age verification to sell
- Any item prohibited by applicable law or regulation
Home & Furniture is collection-only. Large items that cannot be carried by any ASiS delivery option may only be listed for collection.
If you are unsure whether an item is allowed, do not publish it — email support.service@asis.website first. Asking never counts against you.
16. Prohibited conduct
Respectful conduct
Users must treat other users, ASiS staff, moderators, support representatives, contractors and service providers with respect at all times. The following are strictly prohibited:
- Harassment, bullying, intimidation or abusive behaviour
- Threats of violence, harm, retaliation, or legal action made in bad faith
- Hate speech, discriminatory language, or content targeting protected characteristics
- Repeated unwanted contact with another user or a member of the ASiS team
- Sharing another person's private, confidential or personal information without their consent
- Malicious, false or vexatious reports intended to harm another user or the Platform
- Attempts to evade, circumvent or create new accounts following a suspension or ban
ASiS operates a zero-tolerance approach to serious abuse, threats, harassment, intimidation, hate speech, or conduct that makes members of the community or the ASiS team feel unsafe. Depending on severity we may remove content, restrict account functionality, remove listings, suspend accounts, withhold funds where permitted, or permanently ban users without prior warning.
Circumventing the Platform
Users must not attempt to circumvent, bypass, interfere with or undermine Platform rules, account restrictions, moderation decisions, verification requirements, payment systems, shipping systems, security controls, fraud-prevention measures, or any other safeguard. In particular, users must not:
- Circumvent escrow or arrange payment outside ASiS checkout
- Arrange an off-platform transaction through in-app messages or a listing
- Manipulate reviews, ratings, feedback or offers
Platform security and integrity
Users must not attempt to interfere with, probe, test, exploit, disrupt, overload, scrape, automate, reverse engineer, bypass or otherwise compromise the security, operation, availability or integrity of the Platform; access areas they are not authorised to access; use bots or scripts to manipulate listings, searches, messages, reviews, offers, transactions or moderation systems; or attempt to access data belonging to other users without authorisation.
Such activity may result in immediate suspension, permanent banning, legal action, or referral to law enforcement.
Impersonation, fraud and off-platform payment requests
Users must not impersonate ASiS, its staff, moderators, support representatives, or any other person or organisation. Users must not send messages that request bank details, card details, passwords or security codes; direct users to external websites for payment, verification or account activation; or attempt to mislead, deceive or defraud.
ASiS will never ask for your card details, online banking credentials, passwords or security codes in a message. All payments and payouts are handled through Stripe.
Payment abuse
Users must not misuse payment disputes, chargebacks, refund mechanisms or payment-provider protections. Where we reasonably suspect payment abuse, fraudulent chargebacks, or attempts to obtain goods or funds dishonestly, we may suspend accounts, recover losses, withhold funds, remove listings, or take other enforcement action.
17. Listing moderation, automated review and appeals
Listings and account activity are subject to human review and, where relevant, automated screening.
- An automated flag is a signal, not a finding. On its own it does not change your account standing and does not withhold funds.
- Listings may be hidden temporarily pending review by a member of the ASiS team. Temporary measures are reversed and leave no record if the review clears the listing. An automated hide is looked at by a human within 72 hours.
- No moderation action affecting your account, listings or funds is taken solely by an automated system without human oversight.
- Every moderation action is recorded against a structured reason — for example, item not authentic, prohibited item, condition described misleadingly, spam or duplicate listing, suspected stolen goods, someone else's photos or brand, safety risk, or an attempt to sell off-platform — together with a plain-English explanation you can read.
- Outcomes are proportionate to severity: guidance and listing removal at the lower end, feature restrictions in the middle, suspension for serious breaches, and permanent closure for the most serious conduct such as fraud or organised counterfeit selling.
Notice and appeals
Where we take action against your account or a listing we will tell you what we did, why, what it affects and how long it lasts. You may appeal once, free of charge, within 14 days. Appeals are reviewed by someone not involved in the original decision, and we aim to respond within 7 days. If an appeal succeeds the action is reversed: listings are restored and any funds withheld in connection with that decision are released.
18. Account suspension and withholding funds
ASiS may restrict, suspend or permanently close any account that breaches these Terms; engages in fraudulent, deceptive, abusive, threatening, unlawful or harmful behaviour; is suspected of fraud, payment abuse, account manipulation, counterfeit goods, prohibited items, money-laundering concerns or circumvention of Platform safeguards; provides false, forged, altered or fabricated information or evidence during a dispute, investigation or verification check; attempts to evade previous restrictions; or fails to meet our trust, safety, verification or compliance requirements.
We may delay, restrict or temporarily withhold withdrawals, payouts or balances while investigating disputes, chargebacks, fraud concerns, suspicious activity, policy violations, or legal and regulatory requests. Funds may remain restricted until the investigation has concluded.
Decisions relating to restrictions, suspensions and closures are made by a member of the ASiS team and are notified to you with a reason. You may appeal once, free of charge, within 14 days (section 17). Following an appeal decision, the outcome is final.
19. Reviews and feedback
- A buyer may leave a review only after confirming receipt of an order. Reviews are tied to a real, completed transaction.
- Reviews are a 1–5 star rating with optional written feedback and an optional fit note (runs small / true to size / runs large).
- Reviews must be honest and must relate to the item and the transaction. They must not contain abuse, threats, personal information or content unrelated to the order.
- Buying, selling, exchanging, incentivising or coercing reviews, and any form of feedback manipulation, is prohibited.
- ASiS may remove or hide a review that breaches these Terms, that relates to something outside the seller's control (for example a carrier delay), or that is the subject of an open dispute.
20. Messages and notifications
The Platform provides in-app messaging between buyers and sellers. Messages must not be used to arrange off-platform transactions or payment.
Messages may be reviewed by ASiS staff where a report, dispute or investigation requires it.
By creating an account you agree to receive service and transactional communications — order updates, dispute updates, security and account notices — by email and, where enabled, push notification. These are required to operate your account and cannot be switched off while your account is active. Marketing and optional email categories can be managed in your notification settings or via the unsubscribe link in those emails.
21. Your content and our licence to use it
By uploading photographs, videos, descriptions or other content to a listing, a condition report, a storefront or a review, you confirm that you own the content or have permission to use it, and you grant ASiS a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt, resize, crop, re-format, publish, display and distribute that content for the purposes of operating, promoting and marketing the Platform. This includes:
- Displaying the content within the Platform, including in search results, category pages, recommendations and similar-item modules
- Featuring listings or item photographs in marketing material, social media posts, paid advertising, email newsletters, push notifications, blog posts, press material and partner promotions
- Cropping, resizing, adding overlays such as price tags, "Sold" badges or ASiS branding, and re-formatting for different placements
Where reasonably possible, ASiS will credit the seller's username when featuring a listing. This licence continues for as long as the listing is live and for a reasonable period afterwards to cover historical marketing material already published. You may ask us to stop using a specific image in future marketing by contacting support; this does not require us to recall material already distributed.
This licence does not transfer ownership of your content — you retain all underlying rights.
Dispatch and unboxing evidence, and evidence submitted to a dispute, is used only to operate the Platform, to decide disputes and to meet our legal obligations. It is not used for marketing.
22. Intellectual property
ASiS may remove listings, restrict accounts or take other enforcement action where we receive a complaint or reasonably believe that content may infringe trade marks, copyright, design rights, patents or other intellectual property rights. Users are responsible for ensuring they have the right to list, sell and use any content uploaded to the Platform.
The ASiS name, logo, wordmark and the design of the Platform belong to ASiS and may not be used without permission.
23. Tax, VAT and HMRC reporting
ASiS is VAT registered. Where VAT is chargeable on amounts ASiS charges for its own services, the applicable VAT treatment is reflected in the price or checkout information provided to you. Seller-to-buyer item prices are set by sellers, and sellers remain responsible for their own tax obligations.
UK online marketplaces may also have information-collection and reporting obligations in relation to sellers. ASiS may collect and report seller information to HMRC where required by law.
When you set up payouts we collect your legal name and date of birth (or registered business name and company number), your address, and a tax identifier — your National Insurance number if you are an individual, or your UTR or company number if you sell as a business. Payouts cannot be released to your bank until these details are complete.
These details are stored in a separate, restricted record. They never appear on your public profile, shop or listings.
Once a year we report sellers who cross HMRC's thresholds: 30 or more sales, or roughly £1,700 (€2,000) in sales, in a calendar year. The report contains your identity details and your totals for that year — number of sales, gross amount, fees charged and shipping.
Being reported does not mean you owe tax. Most people selling their own second-hand belongings owe nothing. You can see your own running totals and whether you are above the threshold under Profile → Earnings.
ASiS cannot give tax advice. Check your own position with HMRC.
24. Data protection, cookies and analytics
ASiS is the data controller for personal data processed through the Platform. How we collect, use, store and share personal data — including with our payment and identity partner (Stripe), our carriers (InPost, Evri, Royal Mail) and our infrastructure providers — is set out in our Privacy Policy and Cookie Policy.
The Platform uses cookies and similar technologies as described in our Cookie Policy. Our current Cookie Policy states that ASiS does not use analytics, advertising cookies, tracking pixels or third-party marketing tags, and that essential local storage is used for functions such as sign-in, cookie preferences and beta access.
25. Platform availability
ASiS does not guarantee uninterrupted, secure or error-free access to the Platform. We may modify, suspend, restrict, discontinue or update any part of the Platform, its features or its functionality at any time. During beta, features may change or be withdrawn at short notice and data may be reset.
26. Relationship between users and ASiS
ASiS provides a marketplace platform and is not a party to the contract of sale between a buyer and a seller. The contract for the item is between those two users.
Nothing in these Terms creates any partnership, employment, agency, franchise or joint venture between ASiS and its users. Users act independently and are solely responsible for their own conduct, listings, transactions and compliance with applicable laws.
ASiS does not inspect, test, authenticate, refurbish, certify or verify the condition or authenticity of any item listed, except where an item carries a badge that expressly says otherwise. Listings and condition reports are created by users and are the seller's own.
27. Limitation of liability
We are not liable for the quality, safety, authenticity or legality of items listed by users. Our responsibility is limited to the buyer protection cover described in section 11.
To the fullest extent permitted by law, our total liability arising out of or in connection with these Terms is limited to the fees collected by ASiS in relation to the transaction giving rise to the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. Nothing in these Terms affects your statutory rights as a consumer.
28. Complaints, governing law and jurisdiction
If you are unhappy with a decision or with any aspect of the service, contact ASiS support at support.service@asis.website. We aim to acknowledge complaints within 5 business days and to provide a final response within 14 days. Complaints should be raised through ASiS support before any other action.
ASiS intends to make an independent consumer ADR route available through Retail ADR, an authorised ADR provider for consumer-goods disputes. Retail ADR is listed by the Chartered Trading Standards Institute as an authorised ADR provider for the retail sector and provides consumer redress free of charge. ASiS will only state that it participates in the scheme once its participation arrangement is active. If you contact us before that arrangement is active, we will tell you what complaint or redress arrangements are available to you at that time.
Nothing in this section prevents you from exercising any statutory rights or bringing a claim in court. Where applicable, ASiS will provide any ADR information required by law when communicating the outcome of a complaint.
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that if you live in Scotland or Northern Ireland you may also bring proceedings in the courts of the country where you live.
29. General
Severability. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in full force.
No waiver. A delay or failure by ASiS to enforce any provision does not waive our right to enforce it later.
Entire agreement. These Terms, together with our Privacy Policy, Cookie Policy, Listing Rules and other Platform policies, form the entire agreement between you and ASiS.
Assignment. You may not transfer your account or your rights under these Terms. ASiS may transfer its rights and obligations to another business, for example as part of a reorganisation or sale.
Force majeure. ASiS is not liable for failure or delay caused by events outside our reasonable control, including carrier disruption, strikes, outages of third-party providers, extreme weather, or acts of government.
Third parties. No one other than you and ASiS has any right to enforce these Terms.
30. Changes to these Terms
We may update these Terms from time to time. When we do, we will notify users and may require re-acceptance of the updated Terms before continued use of the Platform.
